Commentary

It is often prudent for an employer to stand down or suspend an employee in situations involving misconduct, or allegations of misconduct, while an investigation is being undertaken.

The Workplace 'Letter to employee advising stand down during investigation' highlights that disciplinary action, including termination of employment, may follow if the allegations against the employee are determined to be well-founded.

This letter also indicates that the employee will continue to be paid their ordinary remuneration during the period of stand down. There is no automatic right to stand down an employee without pay. Please seek further legal advice if you are seeking to stand down an employee without pay.
