Introduction to the toolkit

Our DIY toolkit gives you everything you need to meet your positive duty requirements under the Sex Discrimination Act. Designed to save you time and give you confidence, it provides the essential steps, tools, and training to prevent sexual harassment and related unlawful behaviour in your workplace.

The law has changed

As of 12 December 2023, every Australian employer must take reasonable and proportionate steps to eliminate sexual harassment and other unlawful conduct before it happens. Responding only when issues arise is no longer enough.

This applies to all businesses, no matter your size or industry. There are no exemptions.

The cost of inaction

If you fail to comply, you could face:

  • Enforcement action by the Australian Human Rights Commission
  • Significant financial penalties
  • Serious reputational damage

In Queensland, you also have additional WHS obligations, including a written Prevention Plan. Non-compliance can result in fines of up to $29,034.
